GENERAL TERMS AND CONDITIONS.
Article 1: Personal membership
1.1 Membership is entered into for an indefinite period and takes effect upon signing of the registration form.
1.2 The membership applies exclusively to the stated activities and the indicated duration and price.
1.3 The membership is strictly personal and non-transferable.
1.4 If joining during the current month, a pro-rata amount for the partial month will be charged, after which the membership commences on the first of the following month. Personal Training Subscriptions commence on the 1st of the month.
1.5 The minimum age to take out a subscription independently is 18 years.
1.6 Subscription plans for 1-on-2-4 Personal Training sessions must take place with a minimum of 2 people. If one of the two people is unable to attend, the appointment must be rescheduled. Should the member still wish to train, a single 1-on-1 Personal Training session can be purchased.
1.7 Should the member be unable to attend a Personal Training appointment for any reason, this must be reported well in advance, but in any case no later than 24 hours in advance. Cancellations made less than 24 hours in advance will be charged.
1.8 Should the member wish to switch to an alternative Gympact membership, the member may submit this request via email to info@gympact.nl. If the member is eligible, the new membership can commence on the 1st of a subsequent calendar month.
Article 2: Membership Fees
2.1 Membership payments are settled monthly via SEPA direct debit. The due membership fee is debited at the beginning of the month.
2.2 If collection is not possible as described in article 2.1, we are entitled to refuse the member access to Gympact. However, this does not release the member from the payment obligation.
2.3 If you require an invoice for your own records or to claim reimbursement from your employer, you can download it in the app.
2.4 A one-time registration fee of €15.00 applies upon registration. This will be automatically debited. Upon registration, the member receives an invitation by email to use the app.
Article 3: Opening Hours & Rates
3.1 Gympact is entitled to change the opening hours, class schedules, and rates at any time. During official holidays, Gympact reserves the right to close the club, without this resulting in a reduction of membership fees or any refund thereof.
3.2 If Gympact is only able to offer its facilities partially due to a government restriction, payments already made by the member will not be refunded. Gympact has the right to offer a new (comparable) outdoor and online subscription during a period of closure due to government restrictions. This subscription type is valid for as long as Gympact is unable to offer its facilities indoors, or can only offer them partially. If the government restriction is lifted, Gympact's facilities will be offered fully again as soon as possible. During a period in which a restriction on indoor sports is imposed by the government, Gympact has the right to continue collecting subscription fees in accordance with the subscription concluded by the member at that time.
3.3 Gympact may adjust the rates once a year based on the Consumer Price Index of Statistics Netherlands. This price change will be communicated at least one month in advance.
Article 4: Registration and cancellation of lessons
4.1 Participants must register for a class in advance via the designated online registration system. Participation in a class is not possible without registration.
4.2 Participants may cancel their registration up to 24 hours before the start of a group lesson or appointment. Without cancellation and/or in the event of late cancellation, one registration credit will be lost.
Article 5: Suspension of membership
5.1 If, as a result of an injury, illness, or pregnancy, the member is completely unable to use the facilities for more than one month, it is possible (exclusively upon presentation of a medical certificate from a doctor) to temporarily pause the membership. The membership may be paused for a maximum of 3 months. Pausing is only possible in full calendar months, effective from the next calendar month. The end date of the membership will be automatically extended by the same period as the duration of the pause.
Article 6: Termination
6.1 Membership can only be cancelled in writing (via email for Gympact Volendam to info@gympact.nl, for Gympact Amsterdam to info.amsterdam@gympact.nl). The notice period is one full calendar month.
6.2 Termination must be effected by the member themselves or by their legal representative.
6.3 Suspension of membership can never be retroactive.
Article 7: Risk and liability
7.1 Gympact is not liable for any damage or injury suffered by the member. All activities undertaken by the member at Gympact are at their own risk. Nor is Gympact liable for damage caused by the loss or theft of items in its buildings.
7.2 To the extent that the liability excluded in the previous paragraph is not accepted by the court, any liability of Gympact shall be limited to the maximum payout for which it has insured its liability, specifically to the amount paid out by its insurer in respect of this liability.
Article 8: Photos and video recordings
8.1 During your presence at Gympact, photos and video recordings may be taken of you for promotional purposes. By accepting these terms and conditions, you grant Gympact permission to use these photos and video recordings for the aforementioned purposes.
Article 9: House Rules
9.1 The member must abide by the following house rules:
9.2 If the member fails to comply with the house rules, we are authorized to terminate the membership immediately and deny the user access to Gympact.
